California Code of Civil Procedure 872.240 is the California partition statute that allows joinder of real and personal property division such that they can be divided in a single partition action. The statute provides that:
Real and personal property may be partitioned in one action.

In a partition action, joinder allows real property division as well as personal property division to both be heard in a single trial. While both real and personal property may be divided in the partition action, real properties that are divided via a partition action may not necessarily be sold as a single unit. In fact, there is a preference for selling a property in distinct lots or parcels over selling it as a whole. [1]
