Code of Civil Procedure § 874.323 (CCP) – Supersedes the Electronic Signatures in Global and National Commerce Act (Partition Actions)

California Code of Civil Procedure 874.323 is the California partition statute explaining e-signatures under the California Partition of Real Property Act:

This act modifies, limits, and supersedes the Electronic Signatures in Global and National Commerce Act (15 U.S.C. Sec. 7001 et seq.), but does not modify, limit, or supersede Section 101(c) of that act (15 U.S.C. Section 7001(c)), or authorize electronic delivery of any of the notices described in Section 103(b) of that act (15 U.S.C. Section 7003(b)).

The legislative history provides little guidance as to the use of this statute, and why it exists only under the Partition of Real Property Act. It may be that this section is in reference to the definition of a “record” for the purposes of exempting a property from the Partition of Real Property Act as including a record in “electronic” form. See California Code of Civil Procedure Section 874.312(d) (“’Record’ means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form.”).
