Experienced Real Estate Partition Action Attorneys Serving Dinuba
Talkov Law’s attorneys serving Tulare County are exceptionally experienced in the area of California partition actions. A California partition action is a law that allows co-owners of real property to divide the property among themselves. The partition statutes provide a legal mechanism for co-owners to divide the property without having to go through the court system. The partition statutes also provide a way for co-owners to force the sale of the property if they cannot agree on how to divide it. The partition statutes also set out the procedures for the sale of the property and how the proceeds of the sale will be divided among the co-owners. The partition statutes also provide for the payment of costs associated with the sale of the property.
Our team of partition attorneys can assist co-owners with frequently asked questions about partitions, such as:
- What are the grounds for a partition action in California? A co-owner is “entitled to partition as a matter of absolute right,” meaning “he need not assign any reason for his demand; that it is sufficient if he demands a severance; and that when grounds for a sale are duly established it may be demanded as of right. To grant it is not a mere matter of grace.” De Roulet v. Mitchel (1945) 70 Cal.App.2d 120, 123-124.
- How to force the sale of jointly owned property? A partition action is the only statutory method to ensure the end of the co-ownership dispute.
- Can heirs force the sale of property? Heirs can force the sale of real property in California once that property is distributed to them. However, sometimes, the property is still held in a trust where the trustee will sell the property. When there is no trust, the probate court may decide that the probate administrator will sell the property before it is distributed in fractional interests to the heirs.
- What is a partition action and when is it necessary?
- What are my partition rights for inherited property? Co-owners of inherited property generally have the absolute right to force the sale of the property through a partition action.

Wade v. Deray – Partition Action Case Study
In the legal case of Wade v. Deray, 50 Cal. 376 (1875), the issue was whether a partition of real property could be made without the consent of all the owners. The plaintiff, Wade, owned a one-third interest in a piece of real property with two other owners, Deray and another individual. Deray and the other owner wanted to partition the property, but Wade refused to consent. Deray and the other owner then sought to partition the property without Wade’s consent. The court held that a partition of real property could not be made without the consent of all the owners, and thus Wade’s refusal to consent was valid.
